VIP CARD TERMS AND CONDITIONS

The following trading terms and conditions relate to the provision of any goods, offers or services by Masefield House Pty Ltd trading as Australian Diamond Company (“ADC”) to you (“the customer”) and the use of the ADC VIP Card.

1. All purchases of goods from ADC are subject to the ADC Terms and Conditions set out on the back of all Purchase Receipts.

1. Only the Member stated on the VIP Card Application may use the VIP Card.
2. The Member must produce the original VIP Card in order to obtain any discount.
3. Discounts shall only apply to full priced standard ticket price of goods sold by ADC and shall not apply to custom or special order goods or services.
4. The VIP Card and any associated discounts or offers can not be used in conjunction with any other offer.
5. ADC may suspend, terminate, cancel, revoke or vary the VIP Card or any offer in connection with the VIP Card at any time without notice.
6. Lost or stolen ADC VIP Cards must be reported to ADC.
7. The VIP Card is non transferable and any offer or discount cannot be redeemed for cash.
8. If your personal information is not provided or the information is inaccurate, false or incorrect your VIP Card may be cancelled.
9. The VIP Card is subject to the following Privacy Statement:
   1. ADC is committed to maintaining the confidentiality and security of personal information we hold. This privacy policy outlines the manner in which we collect, store and use personal information.
   2. ADC collects personal information for the purposes of providing offers, goods and services to customers. Any use of the information will be in accordance with the customer’s directions. Where information is required to be disclosed by law, we will only disclose necessary information.
   3. Customers wishing to access their personal information held by ADC may do so by prior written request. We may also use your personal information (or be provided and used by our partners, associates and other third parties we deal with both in Australia and overseas) to keep you informed of our goods and services, website changes and other matters that we consider may be of interest or relevance to the customer,  internal auditing and administration, adding your name to contact lists, guest lists or invitation lists or helping us to identify production and broadcast activities which may be of benefit or interest to you and to assist us in the provision of our goods and services to you. If a customer does not wish to be contacted for these purposes, please let us know using the contact details set out below.
   4. If personal information held by ADC is inaccurate or out of date the customer or user has the right to request it to be updated or corrected.
   5. ADC reserves the right to change this Privacy Policy from time to time. The latest Privacy Policy will be available from the offices of ADC and from its website www.australiandiamondcompany.com.au.
   6. 10. By signing the VIP Card application you agree to be bound by these Terms and Conditions as varied from time to time by ADC. All variations to these Terms and Conditions shall be available from the offices of ADC and on the ADC website.
11. Except as provided in any law which cannot lawfully be excluded or modified by agreement, ADC does not accept any liability for any act or omission with respect to the VIP Card, any breach of these Terms and conditions or any term implied by law any failure, delay or inability to provide any VIP Card, or other benefit or offer to you caused by any circumstance.
12. These Terms and Conditions shall be governed by the laws of Victoria.
